This month, Polymarket used parts of the NFL’s insignia in its app without permission, and Kalshi used images from the NFL and the NFL Players Association to promote its sports prediction markets on social media.
The businesses are taking this action while the NFL assesses its long-term strategy for prediction markets, which are an alternative to regular sportsbooks that are rapidly expanding and do not fall under state laws.
The San Francisco 49ers and Seattle Seahawks logos were displayed alongside images of 49ers quarterback Brock Purdy and Seahawks running back Kenneth Walker III in a Kalshi promo last week. The platform’s predictions for Sunday’s Week 1 showdown were displayed beneath those pictures. “Bet on football legally” was the slogan of the advertisement.

Other Kalshi ads utilized the terms “NFL” expressly, and one used the trademarked term “Super Bowl,” which the league has always been quite vigilant about protecting.
Sportico was informed by an NFL representative that “we have no business agreement with Kalshi.”
